How to cite these Terms. Each rule has a section number (for example, Section 3.2). References to a section include its subsections.
1. Agreement and policy hierarchy
1.1. These Terms & Conditions ("Terms") govern use of the Dopamine Flowers website, online store, custom-order and payment links, reminders, communications, products, delivery, pickup, and related services. By placing an order or using the services, the user agrees to the version in effect at that time.
1.2. The Refund Policy, Shipping Policy, and Privacy Policy are incorporated into these Terms. A signed or expressly accepted wedding, event, rental, installation, or custom-order agreement controls over these general Terms only for a direct conflict concerning that order.
1.3. Nothing in these Terms waives a right or remedy that cannot lawfully be waived.
2. Eligibility and authority
2.1. A purchaser represents that the purchaser can legally enter a contract and is authorized to use the selected payment method. A person ordering for a business or another person represents that the person has authority to do so.
2.2. Account and checkout information must be accurate and current. The user is responsible for safeguarding account credentials and promptly reporting suspected unauthorized use.
3. Handmade products, photographs, and dimensions
3.1. Flowers and plants are natural, seasonal, perishable materials. Photographs represent the intended palette, scale, style, and overall design, but no two arrangements are identical. Bloom stage, stem shape, color tone, foliage, wrapping, ribbon, vase, flower box, and other natural or handmade details may vary.
3.2. Product dimensions are approximate and measured near the arrangement's tallest and widest points at completion. Natural stems settle and open over time. Unless a written custom specification states otherwise, a reasonable variation in height or width is not a defect.
3.3. Product titles such as Small, Medium, Large, Premium, or Deluxe describe the listed variant and value level; they are not standardized measurements unless dimensions are displayed for that variant.
4. Substitutions
4.1. By ordering a floral design, the purchaser authorizes reasonable substitutions required by seasonality, freshness, supply, weather, or quality. We will preserve the arrangement's overall style, primary color direction, scale, and value as closely as reasonably possible and use replacement materials of equal or greater value.
4.2. For a single-variety design, signature container, branded add-on, exact flower request, or element identified in writing as essential, we will attempt to contact the purchaser before a material substitution. If we cannot obtain approval and cannot fulfill without materially changing the order, we may offer another design or date or cancel and refund the affected item.
4.3. A substitution may change stem count because flower varieties and market prices differ. Value is assessed using the materials and design supplied, not stem count alone.
5. Prices, errors, taxes, and payment
5.1. Prices are shown in U.S. dollars. Applicable tax, delivery fee, priority-window fee, and other disclosed charges are shown before payment. Prices and availability may change before an order is placed.
5.2. Payment must be authorized before fulfillment unless we agree otherwise in writing. A bank authorization or automated receipt does not prevent us from declining an order for suspected fraud, an obvious pricing error, unavailable materials, an unreachable address, safety concerns, or lack of capacity. If we decline a paid order, we will void or refund the affected amount.
5.3. We may correct an obvious website, inventory, price, discount, or description error before fulfillment. We will not replace an agreed price with a higher price without the purchaser's consent.
6. Order acceptance and customer responsibilities
6.1. The purchaser must review the product, variant, delivery date, delivery window, recipient name, telephone number, address, unit, gate or facility instructions, gift message, and contact information before submitting the order.
6.2. We may contact the purchaser or recipient to clarify delivery, substitution, safety, payment, or design information. Failure to respond can delay fulfillment or require cancellation under the Shipping or Refund Policy.
6.3. We may limit quantities or refuse an order that appears fraudulent, abusive, unlawful, intended for unauthorized resale, or unsafe for our staff, couriers, recipient, or property.
7. Custom, wedding, event, funeral, rental, and installation work
7.1. A consultation, estimate, cart, or draft invoice does not reserve a date or materials. A custom order is reserved only after any required agreement, deposit, and payment are completed.
7.2. Custom work may require non-refundable design time, special-order materials, rental deposits, minimums, damage charges, setup or teardown fees, and separate cancellation or rescheduling rules disclosed before payment.
7.3. The purchaser or authorized venue contact is responsible for accurate service times, access, placement approval, venue rules, permits, and removal arrangements. Delivery to a funeral home, cemetery, hospital, hotel, military installation, school, or event venue is subject to that location's procedures.
8. Delivery, pickup, cancellations, and refunds
8.1. Delivery and pickup are governed by the Shipping Policy. Returns, claims, order changes, cancellations, replacements, credits, and refunds are governed by the Refund Policy.
8.2. A requested date or time is not guaranteed except to the extent an exact service is expressly sold and confirmed. High-volume dates, traffic, weather, facility restrictions, and safety conditions can affect timing.
9. Gift messages, reviews, photos, and submitted content
9.1. The purchaser is responsible for submitted messages and instructions. We may refuse or omit content that is unlawful, threatening, harassing, discriminatory, deceptive, sexually explicit, defamatory, invasive of privacy, or likely to endanger a person.
9.2. A person submitting a review, photo, or other content represents that the person owns it or has permission to submit it. Unless separate permission is obtained, customer-facing proof photos are used for fulfillment and support, not automatically for public marketing.
10. Promotions, credits, and gift cards
10.1. A promotion may have its own eligibility, date, product, quantity, or combination restrictions. Promotions are not retroactive, have no cash value, and may not be combined unless stated. We may cancel misuse or correct an improperly applied promotion.
10.2. Store credit and gift cards are governed by the terms disclosed when issued and applicable law. A credit offered as a voluntary resolution does not replace a cash refund when law requires a refund to the original payment method.
11. SMS, calls, email, and electronic records
11.1. The purchaser authorizes non-marketing communications reasonably necessary to process and deliver the order using contact information supplied at checkout. Consent to marketing is not a condition of purchase.
11.2. For automated or recurring SMS, message frequency varies and message and data rates may apply. Reply STOP to opt out of applicable automated texts or HELP for help. Opting out of marketing does not prevent a manually initiated message or call reasonably necessary to resolve an active order where permitted by law.
11.3. The user agrees that contracts, disclosures, receipts, and notices may be provided electronically, without limiting a legal right to request another format where applicable.
12. Product care, allergies, pets, and safety
12.1. Freshness and lifespan depend on variety, temperature, handling, water, sanitation, and care after delivery. Care instructions are guidance, not a guaranteed lifespan.
12.2. Flowers, plants, pollen, floral foam, wire, picks, dyes, preservatives, candles, balloons, chocolate, macarons, and other add-ons may present allergy, ingestion, choking, latex, staining, or pet-toxicity risks. Products are decorative and not for consumption unless expressly sold as food. Keep them away from children and animals as appropriate.
12.3. Food add-ons may be made or packaged by third parties and may contain or contact common allergens. Contact us before ordering if an ingredient or allergy is material; absence of a listed allergen is not a guarantee of an allergen-free environment.
13. Website use and intellectual property
13.1. The Dopamine Flowers name, logos, photographs, designs, text, graphics, and website content are owned by or licensed to us. No license is granted except a limited right to use the website for personal shopping and legitimate business inquiries.
13.2. A user may not scrape the site, interfere with security or checkout, introduce malicious code, impersonate another person, misuse promotions, reverse engineer protected systems, or use the services for unlawful activity.
14. Third-party services and links
14.1. Shopify, payment providers, couriers, communication providers, maps, reviews, and other third parties may provide part of the services. Their separate terms and privacy notices govern their independent services.
14.2. We are responsible for selecting and directing our service providers as required by law, but we do not control an unrelated third-party website that a user chooses to visit.
15. Disclaimers and limitation of liability
15.1. Except for express promises in these Terms and rights that cannot be excluded, the website and services are provided on an "as available" basis. We do not promise that the website will always be uninterrupted or error-free.
15.2. To the fullest extent permitted by law, Dopamine Flowers is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or lost profits, arising from an order or use of the website.
15.3. To the fullest extent permitted by law, aggregate liability arising from a particular order will not exceed the amount paid for that order. Sections 15.1-15.3 do not limit liability for fraud, gross negligence, willful misconduct, personal injury caused by conduct for which liability cannot be excluded, or any non-waivable consumer remedy.
16. Events outside reasonable control
16.1. We are not responsible for failure or delay caused by events outside reasonable control, including severe weather, road closure, natural disaster, fire, utility or network outage, government action, civil emergency, labor disruption, supply interruption, venue closure, epidemic, or unsafe conditions.
16.2. Section 16.1 does not eliminate a refund right required by law for goods that are not delivered. We will use reasonable efforts to contact the purchaser and offer the legally appropriate choice of a new date, approved substitution, cancellation, or refund.
17. Disputes, governing law, and venue
17.1. Before filing a claim, the parties should attempt in good faith to resolve it by sending the order number, facts, photographs or records, and requested resolution to the contact in Section 19. This informal process does not extend a statutory filing deadline.
17.2. These Terms are governed by Hawaii law and applicable federal law, without regard to conflict-of-law principles. Subject to any non-waivable right to another forum, an action relating to these Terms or an order must be brought in a state or federal court with jurisdiction in Honolulu, Hawaii.
18. General terms and changes
18.1. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions remain effective. A failure to enforce a provision once is not a waiver. The headings are for organization, and "including" means "including without limitation."
18.2. We may update these Terms prospectively by posting a revised version and date. The Terms in effect when an order is placed govern that order unless the parties agree otherwise or law requires a different result.
